These booking conditions are valid between the owner of Villas Merula (hereafter called "the owner") and the guest (s) (hereafter called "the guest")who book one of our properties: Villa Merula or Villa Primela (hereafter called "the property" "the house").
Any booking made with the owner directly is subject to the conditions below. For reservations made via agencies or intermediaries different conditions may apply.
2. Reservation and concluding the contract
The owner will email a booking contract and specify the payment required to guarantee the booking. If the booking confirmation demands a pre-payment followed by a balance payment, the both payments have to be made within the given time period. If the booking confirmation demands to make a full payment, the payment have to be made by the due date.
The guest is required to check the details of the booking before making a payment, as well as the confirmation email and inform the owner immediately of any mistakes and errors.
From that moment onward, the rights and obligations of the contractual parties are regulated by these General Terms of Business and apply to the guests and the owner of Villas Merula.
3. Prices and terms of payment
Prices of the accommodation are in EUR. The owner hold his right on the change of the published prices. For guests who paid the advance for a certain reservation, a tenant guarantee them a price which was pointed out when they done the payment.
Price of the accommodation includes a basic service which is fully described in reservation confirmation. The accommodation prices (unless otherwise specified) include: WI-FI, usual consumption of electricity, air-con in summer, water consumption, pool maintenance, final cleaning, bedding, bath towels and tourist tax.
Supplemental services are those which are not included in the price per day and these are extra charged. These services must be asked during the reservation period.
Any additional services requested by the guest are not included in the price and must be paid on the spot to the person in charge of the facility's keys, or to the owner.
The pool heating is available on request (till 15.06 and upon 20.09) aat extra costs of € 200.-/week.
Upon receiving the confirmation of the reservation, the guest has to make and advance payment of 30 % within the next 3 days, which definitely confirms the booking. The balance of the full amount has to be paid at least 30 days before arrival.
For reservations made within 30 days before arrival the total amount of reservation must be paid in the next 24 hours. Payment of reservations made within 30 days before arrival must be reconfirmed by written confirmation (fax or e-mail) of the made payment.
Once the pre-payment or full payment has been received, the guest will receive an email from us confirming the receipt of payment and that the booking is guaranteed. The contract will be formed when the guest receives the payment confirmation email. The guest is also required to make the payment for the Balance within the certain period prior to the arrival date outlined in the confirmation email.
In the case of the guest not sticking to the payment deadlines, the reservation may be cancelled.
Upon arrival, the guest must pay a deposit in cash which is to be stored. The deposit will be returned if there were no damages. Bei Ankunft ist eine Kaution (für Villa Merula € 300.- ; für Villa Primela € 400.-) in bar zu hinterlegen, die bei Abreise abzüglich eventuell entstandener Schäden zurückgezahlt wird.
3.2. Cancellation policy
The reservation can be cancelled free of charge up to 84 days prior to arrival date.
In the event of the guest cancelling the reservation, the following cancellation fees will be charged:
Cancellation is only accepted in writing. The date applicable is the day the written notice of cancellation is received.
Early departure: If you have to depart prior to the end of your rental period, norefund can be granted.
3.3. Travel insurance
We recommend to take out a travel insurance.
4. Check-in / check-out
The minimum length stay in months Juni, Juli and August is 7 nights. The day of arrival/departure is Saturday, unless otherwise specified.
In other months is minimum length stay 4 nights.
Upon receipt of the full payment the owner provides detailed arrival information and the contact details of the local host.
The guest is asked to pay attention to the contact numbers in order to be able to contact the accommodation's owner or a person in charge of the keys. Upon arrival, the guests must give their travel and personal documents to the person giving them the house keys, who will then register the guest by the authorities and immediately return their personal documents.
The estimated time of arrival/departure is listed in the travel documents. The time of arrival must be between 4 PM and 7PM, while the time of departure is till 10 AM. In the event of arrival not being possible before 7 PM, the guest is obligated to notify the travel agent or person in charge of the keys, with whom they will arrange when to collect the keys.
If you are not arriving by midday on the day after the arrival date and do not advise a later arrival we consider your booking as "no show". No refund is made for the fees already paid to us.

5. Guest obligations
The guests agree:
The property may only be used by persons who are registered as guest. The number of guests must not exceed the total number of persons agreed in the booking confirmation. Visitors to the property are to be announced to us.
You are liable for all damage caused by yourself (or members of your party) to the property and its equipment. Please report any damages immediately to us.
The guest undertakes to settle without delay all costs of damage or loss incurred as a consequence of deliberate or non-deliberate acting caused by the guest or other persons spending their holiday with the guest.
You are requested to take all adequate precautions when using the villa and its facilities as well as paths around the house, garden, stairs and pool. The use is at your own risk. Parents are responsible for the actions of their children at all times.
Young children/infants: we have to emphasis that - like in most houses - stairs, swimming pool, balconies, traffic in close vicinity etc. are major areas of risks for young children not being under parental supervision. We do not accept liability for any accident or injury.
We shall not be held responsible for any accident or injury.
We preserve the right to end the contract with an immediate effect when the guest do not obey the house rules.
6. The owner`s obligations towards the guests
The owner must constantly strive to ensure the quality of services rendered, in accordance with legal regulations, industry standards and accepted tourism, hotelier and catering guidelines and customs.
The owner will strive to fulfill his obligations as taken on, in their entirety, except in the case of circumstances outside his control.
The owner is not liable for loss of personal stuff, damaging of personal things or injuries, accidents or events with lethal results during the sojourn of the guests.
Most of the houses are surrounded by gardens or bushes and nature, where the small animal world is still intact. Here you can meet mosquitoes, spiders, beetles, field mice, or non-toxic snakes. These animals know no differences between villas and simple country houses. The owner shall not be held responsible for having small animals in the villa.
The guests use all facilities of Villas Merula on their own responsibility.
The owner shall not be held responsible for any accident or injury.
In the event of disregard of the house rules, the owner has the right to refuse the providing of further service and to terminate the accommodation agreement.
A dog/pet is only allowed at request in Villa Merula. A daily charge of EUR 10,- applies. Refer also to the "house rules" manual.
8. Categorization and service description
Accommodation units are described in accordance with the local categorization of the authorized institution, and each owner of an accommodation unit is required to make the category of the accommodation unit visible.
Standards for accommodation, services, etc. differ from place to place, country to country, and cannot be compared.
9. Court authority
All disputes or disagreements shall be resolved by mutually acceptable agreement, and if a solution cannot be reached, the local competent court in Labin shall arbitrate.
You may not transfer your Booking or any rights and responsibilities under these Booking Conditions to any other person, without our prior written consent.
If parts of the contract are null and void or invalid, the other parts retain their validity. Any agreements not contained in the contract, oral promises or changes have to be confirmed in writing.
